Rauch Dream Events competition

I. Terms and conditions

 

1. Subject

1.1 These terms and conditions and privacy policy govern participation in the ‘Rauch Dream Events’ competition organised by RAUCH Fruchtsäfte GmbH & Co OG, Langgasse 1, 6830 Rankweil, Austria (hereinafter referred to as the ‘organiser’).

1.2 The organiser is also the data controller.

1.4 By participating in the ‘Rauch Dream Events’ competition, participants accept these terms and conditions. Participation in the competition is only permitted on the basis of these terms and conditions.

 

2. Participation

2.1 The opportunity to participate in the competition is limited to the period specified in the event description.

2.2 Only natural persons who are resident in Austria or Germany and are at least 18 years of age at the time of participation are eligible to participate. Participation is only permitted in your own name.

2.3 Employees of the organiser and employees of cooperation partners who are or were involved in the creation or execution of the competition, as well as their close relatives (spouse, partner and direct relatives) are excluded from participation.

2.4 Participation consists of completing the competition form at www.rauch.cc/dreamevents. The following personal data must be provided: first name, surname, date of birth, email address, telephone number, street, postcode and town.

2.5 Participation is only possible within the participation period. Participation can only take place on the specified homepage. Entries received after the closing date will not be considered in the draw. Participation in the competition is free of charge.

2.6 Multiple entries are not permitted.

2.7 The winners will be selected at random.

 

3. Conduct, exemption and responsibility

Participants who violate these terms and conditions may be excluded from participation by the organiser at any time. The organiser reserves this right in particular against persons who participate in the competition even though they are under the age of 18.

 

4. Prizes

The following prize will be drawn among all participants: As described in the prize description for the respective Dream Event.

 

5. Processing

5.1 The winners will be determined after the closing date for entries in a random draw from all participants who have entered the competition by the specified closing date and who have fulfilled the conditions of entry.

5.2 The prizes cannot be paid out in cash or in kind, nor can they be exchanged or transferred to other persons. A selected participant may waive their prize.

5.3 The announcement of the winner is without guarantee. The winner will be notified by email. If the winners do not provide their contact details within 3 calendar days of the email notification and confirm their acceptance of the prize, their claim to the prize shall expire. In this case, the prize will be raffled again. The winners are responsible for the accuracy of the contact details provided. If winners cannot be contacted due to incomplete or incorrect contact details (e.g. by email or post), this shall be at their own expense. In the event of non-acceptance, non-delivery, non-collection, deposit or return to the organiser, etc., the prize will be raffled again. No further delivery attempts will be made.

5.4 Legal recourse is excluded.

5.5 The organiser expressly reserves the right to terminate or limit the competition at any time without prior notice and without giving reasons. No rights can be derived from this by the participant.

 

6. Disclaimer, termination of the competition

6.1 The organiser points out that the availability and functionality of the website www.rauch.cc/dreamevents and thus participation in the competition cannot be guaranteed. This may include technical problems, rule changes, etc.

6.2 The organiser expressly reserves the right to terminate the competition without prior notice and without giving reasons.

6.3. The organiser accepts no liability for lost chances of winning.

 

7. Liability

7.1 The following exclusions and limitations of liability apply to the organiser's liability. Other statutory provisions remain unaffected by this.

7.2 Liability shall only be assumed for direct damage caused intentionally or through gross negligence. Any further liability is excluded, unless personal injury is involved. Liability under the Product Liability Act remains unaffected by this.

7.3 Insofar as the organiser's liability is excluded or limited, this also applies to the personal liability of the organiser's employees, representatives and vicarious agents.

7.4 In the case of travel prizes, the organiser shall also not be liable for the consequences of a justified change to the travel offer or the justified cancellation of the trip by the tour operator. The possibility of paying out the value of the trip is excluded.

7.5 The organiser is not liable for the accuracy of all information, in particular if it has been changed or distorted by technical errors, typing or programming errors, transmission losses, interference by third parties or force majeure.

 

8. Applicable law, severability clause, miscellaneous

8.1 This competition is governed exclusively by the laws of the Republic of Austria, excluding the provisions on the choice of law.

8.2 Should any provision of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a legally permissible provision that comes closest to the meaning and purpose of the invalid provision. The same shall apply in the event of a loophole in these Terms and Conditions of Participation.

8.3 All personal and functional designations used in these Terms and Conditions of Participation, which have been used in the masculine form for reasons of better readability, shall also apply in the feminine form.

 

9. Right to make changes

The organiser may change or supplement these terms and conditions at any time without giving reasons, provided this is necessary.

However, if the data is not provided, participation in the competition is not possible. We process the contact data to register the participants in the competition, to conduct the competition properly and in accordance with the conditions of participation, and to notify the winners. The legal basis for the processing of contact data is our legitimate interest in achieving these purposes. You can object to the processing of your data using the contact details provided above.

C. Recipients and storage period

Within our company, those employees who need the data for their work have access to it.

The data relevant in individual cases will also be passed on to the following external recipients, whereby only data that the respective recipient needs for their task or that we are required to pass on due to legal requirements will be passed on:

a.) Our IT service provider (processor) Inscript GmbH, 6850 Dornbirn, Austria.

b.) Authorities, courts and legal representatives in official and court proceedings or for the enforcement or defence of claims; The recipients listed above are based in the EEA. The contact details will be deleted twelve months after the end of the competition, unless they are required for evidence purposes due to registered or imminent claims or legal obligations require longer storage. D. Rights as a data subject In accordance with data protection regulations, you have the right to information, correction, deletion, restriction of processing, revocation, objection and transferability of your data. These rights can be exercised using the contact details provided above.
